A client came to us recently with a brand name she had been building for ye=

You probably know contracts and legal documents get a bad reputation for being in "fine print."
And let’s be honest, you’ve probably skimmed over some bulky legal jargon a few times in your life too. No judgment here!
But as an attorney, I can absolutely assure you that you should 100% be reading the fine print.
Let’s take a very common legal section people tend to avoid completely! It’s found in the footer of websites and almost never gets a click through.
Yep, it’s the "Terms of Use"/ "Terms & Conditions" and "Privacy Policy."
But why is this important enough for me to take the time to write an entire email about it? Let me explain, Maude.
You already snagged a free online business legal guide from me which is GREAT! That gets you started on your legal to-do list. ✔️
Now we need to get you equipped with a Privacy Policy and Terms of Use!
The Terms of Use is the contract you enter into when you visit or purchase goods or services from someone's website. It is often in teeny tiny print, but just as legally binding as a contract you would sign with a pen. 🤯
Even if you are not selling products, every website needs a [Terms of Use.](https://www.thebusinessstudio.com/policies/terms-of-service)
Here's why...
- It tells your users that your blog posts are for informational purposes only, and that you can't be held liable for any reliance on the content.
- It explains your refund and payment policies.
- It tells your users that you own the intellectual property on your website (your logo, your brand name), and that they can't steal it.
- Most importantly if you ever were to get sued for something related to your website, your Terms of Use spells out where that happens (so you don't get sued in Alaska when you live in Florida).
Even though this may be the least visited of all of your web pages, it’s still just as legally binding as a paper contract.
If you have a website, you need a [Privacy Policy](https://www.thebusinessstudio.com/policies/privacy-policy), which tells your website, visitors, how their personal data is being stored and shared.
You’re legally required to have one if you’re collecting personal info from anyone in the EU or California, or if you run Google or Facebook ads, or use Google Analytics.

Legal Must-Dos for 2026

Most business owners that are just starting out know they need contracts an=
d legal protection, but probably have a lot of questions.
=E2=80=9CDo I really need a contract? Can I just download one off of Google=
? How long can I put off not having a legit contract with my clients?=E2=80=
=9D
The legal side of your business can feel like the junk drawer in your kitch=
en - you know it=E2=80=99s a mess, it feels overwhelming, and you=E2=80=99d=
rather not think about it and pretend like it doesn=E2=80=99t exist.
I get it.
This is how I feel about cardio, taxes, and my son=E2=80=99s closet overflo=
wing with old toys. But having a contract ensures that you get paid, protec=
ts you against doing more work than you bargained for, and limits your liab=
ility in case something unexpected happens.
Contracts state:
- When you get paid (a specific date or milestone)
- How you get paid (credit card, Venmo, etc)
- What happens if clients don=E2=80=99t pay (think interest, late fees, law=
suits)
- What happens if clients institute a chargeback
- Who owns any deliverables created if clients don=E2=80=99t pay, and the l=
ist goes on.
They also make dealing with difficult clients easier, and risk of nonpaymen=
t less likely since there are clear consequences laid out.
Most of the bad contracts I see come from ones that have been pieced togeth=
er from Google, a friend=E2=80=99s contract, or a client management softwar=
e (no offense). They often are not drafted by lawyers, and do not account f=
or industry specific scenarios that coaches and creatives encounter.

Turns out the pictures provided to Elle were paparazzi photos that Elle’s client did not have the right to post, and the Paparazzi was threatening to sue Elle’s celebrity client for it. The client turned it around on Elle and Elle had no choice but to contribute to the settlement amount to the paparazzi.
Horror story number two landed my client (let’s call her Josephine) in a similar situation. She is a web & graphic designer and created a website for a local business using photos she was given. Again…just doing her job!
Later the business was sued by a famous photographer for using these copyrighted pictures on their website, and the business dragged Josephine into the lawsuit. 😳
So how could they have avoided these nightmarish situations?
A client contract!
